TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale are entered into between Growva Pure, a brand operated by MJC AND CO, and any person who makes a purchase on the Growva Pure website, hereinafter referred to as the “Customer”.
Any purchase made on the Growva Pure website (the “Website”) automatically constitutes acceptance of these Terms and Conditions.
ARTICLE 1 – DEFINITIONS
Customer: means any user who purchases a Product through the Website and/or has a personal account on the Website.
Order: means the process by which the Customer selects the Products they wish to purchase and have delivered.
Agreement: means these Terms and Conditions and any specific terms applicable to certain promotional offers.
Personal Data: means all personal information provided by the Customer.
Parties: means collectively Growva Pure and the Users of the Website.
Products: means the products available for sale on the Website.
User: means any individual or legal entity accessing the Website.
ARTICLE 2 – PURPOSE AND SCOPE
2.1. These Terms and Conditions define the conditions under which Users may access the Website, place Orders, and govern the relationship between Growva Pure and its Users.
2.2. They apply to relationships between Users and between Users and Growva Pure.
2.3. Growva Pure reserves the right to modify these Terms and Conditions at any time without prior notice.
2.4. The version of the Terms and Conditions applicable shall be the latest version available on the Website.
2.5. The version applicable to an Order is the version in effect on the date the Order is placed.
2.6. The User declares that they have received all information relating to the Products and delivery from Growva Pure.
2.7. The User must have the legal capacity to enter into a contract or have authorization from their legal representative.
ARTICLE 3 – PRICES
All prices are displayed in euros, including applicable taxes.
Growva Pure reserves the right to modify its prices without prior notice.
The prices applicable to an Order are those displayed on the Website at the time the Order is placed.
ARTICLE 4 – PRODUCT PRESENTATION
The User may freely view photographs and descriptions of the Products on the Website.

ARTICLE 5 – ORDERS
The Customer may place an Order without creating an account.
An Order is confirmed once full payment has been received by Growva Pure.
Growva Pure will send an order confirmation and/or invoice by email.
Orders are fulfilled subject to product availability.
Growva Pure may modify its range of Products at any time, without affecting Orders already placed.
ARTICLE 6 – DELIVERY
Delivery charges are specified during the ordering process and accepted by the Customer.
Estimated delivery times are displayed on the Website and confirmed by email.
Growva Pure shall not be held responsible for delays caused by carriers or circumstances beyond its reasonable control.
The Customer agrees to check the condition and conformity of the delivery upon receipt.
ARTICLE 7 – PAYMENT
Payment is made by credit or debit card through a secure payment provider.
Growva Pure does not retain the Customer’s banking details.
By accepting these Terms and Conditions, the Customer also agrees to the applicable terms and conditions of the payment provider.
ARTICLE 8 – RIGHT OF WITHDRAWAL
In accordance with the applicable legal provisions, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to provide a reason or incur any penalty, subject to the exceptions provided for by law.
In particular, the right of withdrawal cannot be exercised where the products have been unsealed following delivery and cannot be returned for reasons of hygiene or health protection.
To exercise their right of withdrawal, the Customer must contact Growva Pure at mikaelcanahane@gmail.com before the expiry of the statutory period.
Where the right of withdrawal applies, returned products must be complete and in a condition suitable for resale.
The direct costs of returning the goods are to be borne by the Customer, unless otherwise provided for by law.

This wording is preferable to the current version, which conflates the right of withdrawal with cosmetic products. The right of withdrawal is, in principle, 14 days, with exceptions, notably for certain products that have been unsealed for reasons of hygiene or health protection.
ARTICLE 9 – PERSONAL DATA
To exercise their rights of access, rectification or objection concerning their personal data, the Customer may contact:

ARTICLE 10 – GIFT CARDS / STORE CREDITS
Gift cards or store credits issued by Growva Pure are valid for 1 year on all Products available on the Website.
Unless otherwise stated, they cannot be combined with other store credits or promotional codes.
ARTICLE 11 – PROMOTIONAL CODES
Promotional codes cannot be combined with one another or with store credits.
Unless otherwise stated, promotional codes may be used once per Customer account.
ARTICLE 12 – INTELLECTUAL PROPERTY
The Growva Pure trademark, logos, brand identity, graphic design and Website content are the property of Growva Pure and/or its respective rights holders.
Any reproduction, representation, modification or use without prior authorization is strictly prohibited.
ARTICLE 13 – LIMITATION OF LIABILITY
13.1. Growva Pure shall not be liable for damages of any nature arising from the use of the Website or the purchase or use of a Product, except where liability cannot legally be excluded.
13.2. The User accesses and uses the Website at their own risk.
13.3. Growva Pure shall not be held responsible for interruptions, temporary unavailability or technical malfunctions beyond its reasonable control.
13.4. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
ARTICLE 14 – LEGAL WARRANTIES AND GROWVA PURE QUALITY PROMISE™
Products sold by Growva Pure are covered by the applicable statutory guarantees, in particular:
Statutory guarantee of conformity
In accordance with Articles L.217-3 et seq. of the French Consumer Code, the consumer Customer is entitled to the statutory guarantee of conformity for a period of two (2) years from the date of delivery of the product.
In the event of a lack of conformity, the Customer may request that the product be brought into conformity in accordance with the conditions laid down by law, in particular by repair or replacement. Where the legal conditions are met, the Customer may also obtain a price reduction or the termination of the contract.
Statutory warranty against hidden defects
In accordance with Articles 1641 et seq. of the Civil Code, the Customer is also entitled to the statutory warranty against hidden defects where the product has a hidden defect that renders it unfit for its intended purpose or so impairs that use that the Customer would not have purchased it, or would have paid a lower price for it, had they been aware of the defect.
Any claim arising from hidden defects must be made within two (2) years of the discovery of the defect.
These statutory guarantees apply independently of any commercial guarantee that may be offered by Growva Pure and cannot be limited or excluded by these T&Cs.

ARTICLE 16 – MISCELLANEOUS
16.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.2. The failure of Growva Pure to enforce any provision of these Terms and Conditions shall not constitute a waiver of its right to enforce that provision in the future.

16.4. These Terms and Conditions are governed by applicable French law, subject to any mandatory consumer protection laws applicable in the Customer’s country of residence.
